OFFICIAL RULES Billy Packer's Bracket Game
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. BILLY PACKER'S BRACKET GAME ("PROMOTION") IS OPEN ONLY TO LEGAL RESIDENTS OF THE FORTY-EIGHT (48) CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER. VOID IN AK AND HI AND WHERE PROHIBITED. Employees (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Fantasy Sports Ventures ("Sponsor"), The Douglass Group, Inc., and their respective parents, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win. By participating, participants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Promotion. Promotion is subject to all applicable federal, state and local laws.
TO ENTER: Between 12:01 AM Eastern Time ("ET") on March 10, 2009 and 20 minutes prior to the start of the first men's college basketball game of the 2009 Men's Division I Tournament on March 19, 2009 (the "Entry Period"), to enter, log in to http://knight-packer.collegebasketball.upickem.net/collegebasketball/registration/login.asp ("Website") and complete and submit the entire bracket, including the scores of the winning and losing team for the final game. For potential tie-breaking purposes, each participant will be asked to guess the winning and losing team's scores for the final game. Based on the actual score of the game, a "Score Approximation Formula" will be applied to get a "Score Approximation", which will be used in the event of a tie (for further details, see below). The brackets may be changed until twenty (20) minutes prior to the tip-off for the initial game, scheduled to take place on March 19, 2009. No changes will be accepted after the stated deadline. If you are not already a registered member of the Website, you will be required to become one in order to enter. Registration is free. All bracket submissions must be received by the stated Entry Period deadline to be eligible. Limit one (1) registration per person and per email address. Registrations received from any person or email address in excess of the stated limitation will be void. Bracket submissions generated by script, macro or other automated means and bracket submissions by any means which subvert the participation process are void. All bracket submissions become the property of Sponsor and will not be acknowledged or returned. You may create as many profiles as you wish; however, there is a limit of one (1) bracket submission per person and per email address per profile. Bracket submissions from any person or email address in excess of the stated profile limit will be void. Determination of Score Approximation: Based on the score that the participant guesses for the teams participating in the final game, the Score Approximation Formula will be applied as follows to determine a Score Approximation:
1. The difference between the score of the winning team and the winning team's actual score will be squared. 2. The difference between the score of the losing team and the losing team's actual score will be squared. 3. The numbers derived from 1 and 2 will be added to determine the Score Approximation.
The goal is to have the smallest possible Score Approximation. Score Approximations will only be used for tie-breaking purposes.
WINNER DETERMINATION: The 2009 Division I Men's College Basketball Tournament will include a total six (6) Rounds which take place the start of the first game on March 19, 2009 to the end of the last game on April 6, 2009 ("Tournament Period"). One (1) Grand Prize and nine (9) First Prizes will be awarded to the participants who accumulate the highest number of valid Points during the Tournament Period respectively, based on the accuracy of their bracket selections. Points will be awarded according to following scoring system:
Round Points Awarded for Each Team Correctly Selected as a Winner First 2 Points Second 4 Points Third 8 Points Fourth 16 Points Fifth 32 Points Finals 64 Points
In the event that a game is cancelled, forfeited, or if a game results in a tie, that game shall not count for any participant and scores will be computed without the outcome of that game. In the event of a tie between two or more participants for any prize level, the participant(s) with the lower Score Approximation outcome will be deemed the winner(s) for the prize level(s) at issue. In the event that a tie still exists after applying the Score Approximation, the winner(s) for the prize level(s) at issue will be determined based on which participant earned the most Points in the previous Round, and so on, until a winner is determined. If a tie still exists, the winner(s) for the prize level(s) at issue will be selected in a random drawing from among all tied participants for that prize level. Awarding of Points is subject to compliance with these Official Rules. Sponsor's decisions with respect to awarding of Points and other elements of this Promotion are final and binding. Limit one (1) prize per person and per household.
WINNER NOTIFICATION: Potential winners will be notified by phone and/or email. If any winner cannot be contacted within a seven (7) day period, prize will be forfeited and, at Sponsor's sole discretion, a runner-up will be selected. Potential Grand Prize winner will (and potential First Prize winners may) be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release, and any other documents that may be required by Sponsor within seven (7) days of date of issuance. Grand Prize winner will be issued a W-9 for the actual value of his/her prize. If such documents are not returned within the specified time period, prize or prize notification is returned as undeliverable, a potential winner is not in compliance with these Official Rules, or Sponsor is unable to contact a potential winner within a reasonable time period, prize will be forfeited and, at Sponsor's discretion, a runner-up selected for the prize level at issue.
PRIZES: Grand Prize (1): Winner's choice of a trip for winner and a guest OR $2,500 (awarded as a check). Trip consists of roundtrip, coach class air transportation from a major U.S. gateway airport nearest winner's residence to designated location, the opportunity for winner only to appear on a television program with Billy Packer during the 2009-2010 college basketball season (exact dates to be determined by Sponsor in its sole discretion), three (3) days and two (2) nights' standard hotel accommodations (one (1) room, double occupancy) and transportation to/from airport, hotel and location of television program. If winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. Approximate Retail Value ("ARV"): $2,500. Actual value of may vary based on point of departure. Any difference between stated value and actual value will not be awarded. Trip must be taken on dates specified by Sponsor or prize will be forfeited and Sponsor will have no further obligation to such winner. Sponsor reserves right to change dates. Winner and guest must travel together on the same itinerary. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18), unless the child or legal ward of winner and must sign a liability/publicity release prior to issuance of travel documents. If guest is child or legal ward of winner, winner must sign and return release on behalf of such child or legal ward. Travel must be made through Sponsor's agent, on a carrier of Sponsor's choice. Certain travel restrictions may apply. Sponsor does not guarantee the opportunity to appear on the television program. In the event Sponsor is unable to provide such opportunity, winner will be awarded the $2,500 check option and Sponsor will have no further obligation to such winner. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided, including luggage fees, additional transportation, meals, souvenirs, and gratuities are the sole responsibility of the winner.
The television program will be photographed, videotaped and otherwise recorded by the producer of the television program and its designees (collectively, "Footage"). Footage will be owned by the producer of the television program and its designees, who have the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names, performances and likenesses embodied therein, in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade and other purposes without any further notice, permission or payment to participant.
First Prize (9): One (1) mini-basketball autographed by Billy Packer. ARV: $100 each. Prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. Actual value of autographed item is subject to fluctuation based on the current market value at time of prize award.
Total ARV of all prizes: $3,400. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor's sole discretion.
GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered, damaged, or garbled bracket submissions; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the cancellation or postponement of any game, the processing of bracket submissions, the tabulating of Points and scores, the calculation of the Score Approximation, the announcement of the prizes, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the Website. Persons who tamper with or abuse any aspect of the Promotion or Website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated bracket submissions and/or points (as applicable) will be void. Should any portion of the Promotion be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of bracket submissions, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion and, if terminated, at its discretion, select the potential winners using the winner selection procedure outlined above. Participant, by participating, agree that Sponsor, The Douglass Group, Inc., and their respective parents, affiliates, subsidiaries and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, "Released Parties") will have no liability whatsoever for, and shall be held harmless by participants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize (including any travel/activity related thereto) or participation in this Promotion. Each winner, by acceptance of a prize (except where legally prohibited), grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding bracket submissions received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of bracket submission will be deemed to be the participant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
